Terms of Service

These Terms govern your use of Rested Teacher (the "Service"), operated by Keypair Software LLC ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1.Eligibility and accounts
You must be at least 18 years old and legally able to enter a contract to use the Service. You're responsible for keeping your account credentials confidential and for any activity under your account. Notify us at domains@keypairsoftware.com if you suspect unauthorized access.
2.Description of the Service
Rested Teacher generates standards-aligned lesson plans, pacing schedules, and related teaching materials using AI. Outputs are suggestions to be reviewed and approved by a licensed teacher before classroom use. We do not warrant pedagogical correctness, and you remain the professional responsible for what you teach.
3.Subscription, billing, and cancellation
The Service is offered on a subscription basis at the prices posted on restedteacher.com. Subscriptions auto-renew at the same price unless you cancel before the next billing date. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. We do not provide pro-rata refunds for partial months, except as required by law or under our published money-back guarantee window.
Payments are processed by Stripe; by subscribing you also agree to Stripe's terms.
4.Free trial
New accounts may start a free trial of fixed duration (currently 14 days, no credit card required). At the end of the trial, access ends until you add a payment method and subscribe. Trials are limited to one per person; abuse of trial signups may result in termination.
5.Acceptable use
You agree not to:
- Reverse engineer, scrape, or attempt to extract our prompts, models, or data;
- Resell, sublicense, or white-label the Service without a written agreement;
- Use the Service to generate content for use outside your own classroom work;
- Upload or input student personally identifiable information (PII), including names, identifiers, grades, or contact information — see also our Privacy Policy;
- Use the Service in violation of FERPA, state privacy law, or your district's data policies;
- Interfere with the integrity or performance of the Service.
6.Your content and our content
You retain ownership of any lesson plans, notes, or other content you create using the Service ("Your Content"). You grant us a limited license to process Your Content as needed to operate and improve the Service. We do not sell Your Content or share it with third parties except as described in our Privacy Policy.
We retain ownership of the Service itself — the software, prompts, design, branding, and aggregate analytics. AI-generated outputs are licensed to you for non-exclusive classroom use; identical or near-identical outputs may be served to other users via the community lesson library where you have opted in.
7.AI output disclaimer
AI-generated content can contain inaccuracies, omissions, or biased framing despite our best efforts at standards alignment. You are responsible for reviewing every lesson before delivery. We are not liable for instructional, assessment, or compliance consequences of unreviewed AI output.
8.Termination
You may delete your account at any time. We may suspend or terminate your account for violation of these Terms, non-payment, or extended inactivity. Upon termination, your access ends; we retain certain data per our Privacy Policy.
9.Disclaimers and limitation of liability
The Service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, our aggregate liability for any claim arising from or relating to the Service is limited to the amount you paid us in the twelve months preceding the claim.
10.Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any dispute must be brought in the state or federal courts located in Broward County, Florida. You and we waive any objection to jurisdiction and venue there.
11.Changes
We may update these Terms from time to time. We will post the revised Terms with an updated "Last updated" date and, for material changes, notify active subscribers by email. Continued use of the Service after the effective date constitutes acceptance.
